The Board of Zoning Appeals (BZA) considered a special exception request for a junkyard and salvage yard, Petition 4-26, submitted by Truck and Imports Incorporated, Juan Curado, and Carlos Alberto Mendoza. The property, formerly GW Pierce Auto Wrecking Yard, is located at 409 Church Drive and has not operated as a junkyard for several years, losing its lawful non-conforming use status. The petitioners sought a variance from the hard surfacing requirement for the parking area. Staff recommended approval of the special exception and the variance, citing the property's appropriate zoning (I2 industrial), its role in providing necessary auto parts, and the fact that it has historically operated as a junkyard. The board approved the petition and the variance.
BZA Approves Downtown Substance Abuse Clinic Amidst Resident Opposition
The BZA approved Petition 5-26, granting a special exception and three waivers for Gemini Recovery Center, an outpatient substance use disorder clinic at 20 West 8th Street. The clinic, operating in a former lawyer's office zoned B2 (General Business), will offer group counseling, case management, peer support, and recovery planning. It will not provide residential services, detoxification, or walk-in care. The approval included waivers for concrete curbing, a 5-foot green barrier, and the 25% green space requirement. Staff recommended approval, citing the clinic's provision of a much-needed service to address the opioid crisis and its potential to create jobs. Numerous residents and business owners voiced opposition, primarily concerned about the location within the historic downtown district, proximity to alcohol-serving establishments, potential impact on property values, and the historical issues of drug use and homelessness in the area. However, the board ultimately approved the petition, with some members noting the similarity to other professional services already present downtown.
BZA Approves 199-Foot Cell Tower on Cincinnati Avenue
The BZA considered Petition 6-26 for the installation of a 199-foot-tall cell tower at 1400-1500 block on Cincinnati Avenue, submitted by Tower Company 2013 LLC, Silico Partnership, Verizon Wireless, Holly Mose, and Russell Brown. The tower, located on 1.6 acres zoned I1, requires a special exception and a variance from the city's 180-foot height restriction. Staff recommended approval, citing the need to eliminate a coverage gap, offload capacity from other towers, and improve cell service in the Anderson area. The proposed tower is a self-supporting monopole designed to collapse inward. It will be surrounded by a 6-foot privacy fence with barbed wire and will include landscaping. The FAA determined no lighting is required. The board approved both the special exception and the variance.
