The board ultimately voted to deny the appeal, upholding the director's decision but emphasizing the need for a narrowly tailored opinion due to the unique circumstances.
Board of Appeals Approves Sideyard Setback Variance for 111 Wardor Drive Reconstruction
The Board of Appeals considered a variance request for 111 Wardor Drive to reduce the sideyard setback from the required 12 ft to 4.6 ft to accommodate the reconstruction of an existing dwelling and the addition of an attached garage. The existing dwelling, built in 1950, predates current zoning codes. The applicant clarified that the reconstruction would maintain the existing foundation and not encroach further on the property line. Concerns were raised by a board member regarding an increase in lot coverage and stormwater management, to which the applicant responded that they were disturbing less than 5,000 sq ft and were preserving existing trees. The board ultimately approved the variance unanimously.
