Vacation Rental Registration Violation for Florida Cocoa Beach Rental LLC

Florida Cocoa Beach Rental LLC, with registered agent Carol and Tony Springer, was found in violation for failing to obtain a vacation rental registration for the property at 5350 Ocean Beach Boulevard, Unit 2011. The company had obtained a business tax receipt on June 21st, 2026, and a certificate of use on June 24th, 2026, but the final registration was pending the upload of Florida Department of Revenue certification. The listing was active with booked dates on platforms like Airbnb. The magistrate found the violation and determined that the penalty, including potential daily fines, would be determined at a subsequent Massie hearing scheduled for August 7th, 2026.

Noise Violation Fine Affirmed for Micah Rose

The special magistrate found Micah Rose in violation of excessive noise ordinances after a warning had been issued and ignored. The citation was issued on May 5th, 2026, following a noise complaint. Lieutenant Stanley provided testimony that the music was clearly audible and singable from over 100 feet away after 11 p.m., even after a warning was given. The respondent, Micah Rose, admitted to being the manager and accepted the citation. The music stopped after the citation was issued. The magistrate affirmed the $500 fine.

Balcony Safety Violation Leads to Daily Fine for Property Owner

Richard C. Foster, owner of 55 Cedar Avenue, Unit One, was found to be in continued violation of public safety codes due to a dilapidated balcony with missing guard railing. Initially found in violation on April 8th, 2026, Foster was ordered to comply by June 10th, 2026. However, no building permits were obtained by that date, and the balcony remained unsafe. The magistrate found Foster failed to comply in a timely manner and continues to be in violation. A daily fine of $250 was adjudicated, to commence from the date of the order until compliance is achieved. The property is noted as residential homestead.
