Fort Smith Approves Rezoning for Duplex Construction on Xavier Street
The City Board of Directors approved an ordinance to rezone property at 705 Xavier Street. The rezoning involves a master land use plan amendment to 'residential attached' and a zoning change to 'residential multifamily medium density'. This change will allow the property to be platted into two individual lots, with the construction of a duplex on each lot. The Planning Commission had previously recommended approval of this rezoning application. A neighborhood meeting was held on June 9th, where one neighboring property owner attended and raised no objections. Dana Rosa represented the applicant at the Planning Commission meeting.
Fort Smith Approves Easement Acquisition for Consent Decree Sewer Project
The City Board of Directors approved a resolution authorizing the acquisition of sewer utility and temporary construction easements for 42 tracts in connection with consent decree project number 25-12. The total cost for these easements is $5,762. Director of Engineering Todd Mitkey noted that appraisals are typically not required for items under $1,000 or $5,000 in estimated value, and these easements fall within that range, with valuations between $300 and $400. The resolution passed with six in favor and zero opposed.
Tillis Park Parking Lot Bid Analysis Confirms Local Contractor
During the consent agenda discussion, Director Kemp inquired about the bid for Tillis Park parking lot improvements (item 11B), noting it was 12% under the second lowest bidder. Larry Yancey from Hawkins Rear Engineers confirmed that five competitive bids were received, with a significant gap between the low bidder and the second lowest. He stated the low bidder is a local contractor with a good track record with the Parks Department and that there are no reported issues. Mr. Yancey also mentioned the project aims to alleviate some flooding issues for trail users.
Board to Consider Resolution Affirming Non-Litigation Against Petitioners
Director Kemp proposed a motion to formally state the board's intention not to litigate against the petition group seeking a change in government, following the rejection of the special election ordinance. He aimed to demonstrate good faith and ensure the petition process would be respected according to state statutes. Director Rigo reaffirmed his opposition to frivolous litigation and stated the city would not initiate legal challenges.
Director Martin to Miss Next Meeting; Praises 4th of July Event Organizers
In the Officials Forum, Director Neil Martin announced he would be absent from the next meeting due to attending a Young Life camp called Windy Gap with students. He expressed appreciation for the work of Josh and the team in organizing the 4th of July event, acknowledging their sacrifice of personal time.
