Resident Questions Approval Process for Noisy Car Wash
During public comment, Anthony Armando questioned the approval process for the Express Autopa car wash, asking who 'rubber-stamped' it. Mayor Klein clarified that it was a decision by the Planning Board, not the current governing body, and that the Planning Board is not autonomous. Armando expressed a belief that the town's building codes and department standards have declined, leading to the approval of a business that creates a nuisance, and questioned how it slipped through the cracks. He stated the town is 100% liable for the mistake.
Council Approves Various Resolutions, Including Grants and Contract Awards
The council approved several resolutions as part of the consent agenda. These included a resolution for recycling tonnage grant, authorization for inclusion in the Essex County Urban County Community Development Program for 2027-2029, and awards of contracts to Firefighter 1 LLC, Chemco Inc., Jessco Inc., Rapid Pump and Master Company LLC, and Fino and Sons, Inc. Council member Anthony recused himself from voting on Resolution 26-223.
Ordinance Introduced to Amend Uniform Fire Code Enforcement
Ordinance 25-2026, concerning amendments to the uniform fire code enforcement, was introduced and moved for first reading. There was no discussion following the introduction, and the council called for a role call vote. The ordinance will proceed to a public hearing on July 28th.
Livingston Chinese Association Recognized for Community Contributions and 4th of July Support
During the public comment period, Haan Maggie Hu, representing the Livingston Chinese Association (LCA), expressed gratitude for the town's 250th Independence Day celebration. She highlighted the LCA's significant financial sponsorship, volunteer efforts, and community involvement, including organizing an art display and games, and noted that over 30 LCA members serve in leadership and volunteer roles throughout the township. The LCA also received a national outstanding community service award. Council members praised the LCA's contributions and their role in fostering community relations.
Resident Continues to Voice Concerns Over Car Wash Noise Nuisance
Resident Joyce Armando expressed ongoing frustration with the noise emanating from the Express Autopa car wash, deeming it a public nuisance. Despite months of communication and township/county violations, the vacuum operations continue to cause distress. She questioned why the township relies on voluntary measures from the business rather than pursuing legal action as threatened in a demand letter. Town Attorney Jared Caner provided an update, explaining efforts to mitigate noise, including shutting off air hoses and reducing blower intensity, but acknowledging these haven't fully satisfied the resident. He mentioned plans for a sound fence, potential elimination of vacuums during certain hours, and the township's consideration of hiring a sound expert. He also noted the challenge of legally shutting down the business if it remains within state noise limits.
